NEW YORK -- Pfizer Inc. said Monday it would pay $3.3 billion to settle allegations that it used more than 100 clinical trials in the last 10 years to prevent the use of the drug Celebrex.
The deal, which will have a public-private partnership, is the largest such settlement in Pfizer's history, and the company is expected to pay $4.4 billion to settle the litigation, including $7.7 billion to settle cases involving Celebrex, the company said in a statement.
The case, which also involves Celebrex, represents the company's largest drugmaker. Pfizer already has its own research-based company, Boehringer Ingelheim, which was bought by Pfizer in 2003 to provide revenue to a group of insurers, including Aetna, which paid $4.2 billion in 2005 to settle cases involving Aetna.
The deal is part of a broader effort to improve access to medications to people who may have been suffering from serious side effects after taking the drug, the company said.
Aetna is one of the largest drugmakers in the world. It acquired the $3.4 billion-a-year company in 2002, when it was still under patent protection.
Pfizer said Monday it will pay $3.3 billion to settle two cases brought by a group of plaintiffs including two pharmaceutical giant Merck & Co. and Johnson & Johnson, which announced it was appealing the settlement.
Merck was one of the biggest companies to buy Pfizer in the United States in 1998. It had already been sued in federal court over the drug's use in children's sexual-stimulation treatment Janssen.
Merck paid $8.9 billion to resolve the cases, which were settled in 2005, according to a statement from Pfizer Inc. The case was settled for $4.4 billion.
The biggest drugmaker to take the settlement is GlaxoSmithKline Plc, which owns the remaining Pfizer shares.
The deal could be reached at the end of the year, according to the Pfizer press release, which said it is in discussions with the company to finalize the deal.
The U. S. Court of Appeals for the Federal Circuit in Cleveland said it was pleased to see Pfizer move forward and the company has filed a motion to stay its case pending appeal.
The company's largest-selling product, Celebrex, is also set to be approved by the FDA in the first quarter of 2007, said U. District Judge George C. McEvoy in his lower court opinion.
The Celebrex settlement also includes $4.3 billion in royalties from the sales of Celebrex, which Pfizer said it paid for research and development efforts.
